The existence of Universal Health Care exists in most of the industrial nations as a right for every citizen.   In the United States this concept came into being in 2010, the second year of the Obama administration.  Traditionally, in the U.S. up until that time health care was provided by many employers or it was for people who could afford to pay the required premiums.  The idea of Universal Health Care as a right of all citizens began in the United States in 1945 with President Harry S Truman.  It remained an idea because no legislation was passed by Congress.  Under President Lyndon B. Johnson in 1965 Medicare was passed for senior citizens and the disabled.  Former President Harry S Truman received the first card, numbered 1.

 

For younger people, those under 65 years of age, medical coverage had to be purchased.  Millions didn’t have any coverage.  Either their jobs didn’t provide it or they couldn’t afford the required premiums.  In medical emergencies these people had to go to E.R. in hospitals or attempt to ignore their illness.  The hospitals had to provide services even if they could not collect fees for them.

 

It should be noted that even with Medicare medical services are not completely paid for.  Even today many seniors have limited financial resources.  They may have to choose between medicine, food, and/or rent.  Medications also tend to be very expensive.

 

President Bill Clinton had a committee headed by his wife, Hillary, attempt to develop a Universal Health Care Bill during his presidency.  It was finally totally defeated with the slogan, “There has to be a better way.”  The “better way” was no Health Care Bill.  The concept was defeated during his first four years in office.

 

Under President George W. Bush a prescription payment was added to Medicare.  This did not do away with payments for medication but it reduced them considerably with the Federal Government picking up the balance.

 

It should be noted that one of the main groups of contributors to Congressional Elections, particularly Republican elections, is the pharmaceutical industry.  In turn Congress has protected their rights to charge outlandish prices for medications.  Most medications produced by these companies cost far less outside the boundaries of the U.S.  Ironically it is the taxpayers who now pick up most of the cost for medication so that politicians can more easily get contributions.

 

During the second year of the Obama administration, 2010, with the Democrats having control of both houses of Congress, the Affordable Health Care Bill was passed.  As a put-down the Republicans dubbed the bill Obamacare.  President Obama stated that he liked the title and it has been largely called that since.

 

Ironically, in order to make the bill palatable to the Republicans the Democrats built Affordable Health Care from a Republican plan, utilizing private enterprise, the insurance companies, to build a universal health plan.  Obamacare was modeled after a plan that had been developed and used by the state of Massachusetts under the Republican governor, Mitt Romney.

 

Not one Republican voted for Affordable Health Care.  They had all in caucus agreed to not support anything President Obama favored.  They were determined to make him a one term President.  The Bill was passed by the Democratic majority in both Houses of Congress.  Not one Republican voted for the Bill in either House of Congress.  In fact from 2011 on, when the Republicans achieved a majority in the House of Representatives, they voted over sixty times over the next six years to repeal the Bill.  Up until 2014 the Democrats had a majority in the Senate.  In 2015 the Senate barely achieved a Republican majority.  At that time President Obama vetoed the anti-Obamacare Bill.

 

With the election of the Republican Donald J. Trump as President of the United States and with Republican majorities in both Houses of Congress their goal seemed within reach.  But poles ascertained that repeal of that Bill had only 17% approval among the general public.  The majority of Americans want to keep it in existence.  Affordable Health Care had become even more popular than it had been during the time when Barack Obama had been President of the United States. The number of people signing up for it in 2017 increased considerably.

 

Suddenly the Congressional Republicans had a tiger by the tail.  When the Republican legislators went home on their numerous breaks to their districts they faced unhappy constituents who were vociferous in their protest against doing away with Obamacare.  This was particularly true when the Non Partisan Congressional Office that reported upon this bill stated that 14 million people would lose their health insurance coverage if the initial Republican “repeal and replace” health bill became law.

 

After failing to get their “repeal and replace” bill through the House of Representatives the Republicans members were careful to take their two week Easter break.  When they returned there was presumably a new “repeal and replace” bill which was rushed through the House and passed before it had been evaluated by the Non Partisan Budget Office that vets all bills as to their effects.  Since the bill would be massive in size the probability was that most of the Republicans who voted for it had not read it.

 

The new bill is called The American Health Care Act.  From what I understand it makes Health Insurance available to everyone if they can afford the premiums.  Whereas Affordable Health Care attempted to make Health Insurance a right for every citizen the American Health Care Act makes it a privilege for those who can afford it.  The Federal Government will give each state a fixed amount of money which the states can use in helping their citizens pay healthcare premiums.

 

The overall amount which the Federal Government will save is estimated to be around eight billion dollars.  This will allow the Congress to pass what it calls, tax reform.  Congress and President Donald Trump intend to reduce income taxes for the upper 1% and for corporations around eight billion dollars.  The principle here strikes me as reverse Robin Hood, that is, take from the poor and give to the rich.  If this goes through Donald Trump will reduce his taxes considerably.

Fortunately the House of Representatives passing a bill is just that, passing a bill.  The bill then goes to the Senate and the Senate has to pass the bill.  First the bill actually goes to a Senatorial Committee where hearings on it will be held and it will be marked-up, changed or rewritten into a Senate version.  A number of Republican Senators have already stated that they have their own ideas about a Senate version of a Health Care Bill.

 

Once the Senate Committee has come out with their version of the bill it then goes to the full Senate where Senators can still amend the bill before voting upon it.  After amendments are added, and each one must be voted upon separately, the bill is again voted upon by the full Senate.  At best it will have three more Republican votes than Democratic votes.  The count in the Senate is now 52 Republicans to 46 Democrats and 2 Independents who caucus and vote with the Democrats.

 

It is very possible that the Republicans will not be able to get a majority vote and the bill will die in the Senate.  But even if it passes it will be different from the House bill.  Consequently the two bills will go to a Conference Committee made up of members of both Houses of Congress.  They, in turn, will have to come up with a Compromise Bill that is acceptable to both Houses of Congress.  If that were to occur then the new Compromise Bill would have to go to both Houses and be voted upon and passed in both Houses without any changes or it would have to go back to a new Conference Committee.

 

The chances of much of this happening is very small.  The probability is that the bill will not even reach the Conference Committee.  And even if it does it could easily die there.

 

What this bill will achieve is to upset the 14 million people who would lose their current medical coverage if the bill were to pass.  There is a Midterm Election coming up on the first Tuesday in November of 2018.  I am sure the Democrats in each District and State will be happy to remind their constituents of how their Republican representatives voted in 2017 on health care.  It would probably also be worth notifying them that the Republicans refused to raise the minimum wage above $7.25 an hour.  The probability is that the Senate will once again gain a Democratic majority and the House of Representatives could also achieve one.

 

President Donald Trump will likely be tweeting half the night if one or both Houses of Congress had a Democratic majority.  He has essentially been able to get nothing done with Republican majorities in both Houses of Congress.  He will probably get less than nothing done with one or both Houses of Congress in Democratic hands.

As a point of interest, Paul Ryan, the Speaker of the House of Representatives, who is or was a follower of Ann Rand, at least until he found out she was an atheist, is largely responsible for the original new health bill and after the Easter Congressional break for the so-called new version of that bill that the House of Representatives passed.  He says that it is “a bogus attack from the left” to claim that the health care bill was rushed.  I suppose the “left” is the Democratic Party, as the bill was passed strictly along party lines.  No Democrat voted for it.

 

Ryan did not wait for the Non Partisan Congressional Office to study and give the over-all effects of the bill.  Rushing the bill through the House meant, not giving the constituents a chance to complain.

 

It is also interesting to note that Ann Rand basic philosophy, which she applied to her novels dealt with the Hegelian method, thesis vs. antithesis which she turned into individuals acting against each other in her two major novels: The Fountainhead and Atlas Shrugged.  Her form, in both novels dealt with the super individual functioning or struggling against the uncaring group.  In essence it would be the super human vs. the uncaring masses.  I suppose to Ryan it means him against the masses.

 

This philosophy was developed in the late 19th and first half of the 20th Century.  Its prime example would be Germany’s concept of the Master Race.  I would guess that the current Speaker of the House of Representatives mentally includes himself among that group.  This is the man that pushed through the current House Health Bill which will, if passed, take medical insurance away from 14 million people and also increase the wealth of the well to do by decreasing their taxes.

The Weiner Component #128 – The 2016 Presidential Election

If one looks at the Constitution of the United States of America one discovers that it consists of seven articles and twenty-seven amendments.  Of these the first three articles set up the organization and functioning of the Federal Government.   Article 1 deals with the legislative bodies, Article 2 with the presidency, and Article 3 with the Supreme Court.

In the first Article the two legislative bodies, the Senate and the House of Representatives, are defined, organized, and their powers enumerated.   Article 2 sets up the presidency and describes the general powers of the President, and Article 3 essentially states that there shall be a Supreme Court.

According to the Constitution, Congress alone has the power to make the laws.  The President is the chief administrator; he carries out the laws that exist and that the current Congress has brought or brings into being.  The President can issue executive orders, which if they are not in contradiction of existing laws, will exist during his term in office.  But his acts can be curtailed by specific acts of Congress or, for that matter, by decisions of the Supreme Court.  He is mainly the chief administrator of the United States. He runs the country.

During Presidential Elections one gets the impression that most candidates and the general public are totally unaware of what the basic document of the United States contains.  In the current pre-election campaign for the Presidency in 2016 the overly large number of Republican candidates state what they will do if elected.  These individuals sound like they are running to be kings and explain how the country will function if one of them is elected.  What new laws they will decree.  The ignorance is pathetic.

Barak Obama was elected in 2008 on a platform of change.  When he assumed office in 2009 he inherited, from the former President, George W. Bush, a potential economic collapse that would have been greater than the Great Depression of 1929.  By using the resources of the Federal Government, he and his administration were able, over his first two years in office, to turn the economic situation around and totally avoid disaster. Even with the full use of the government for this he was able, with a Democratic Congress, to bring about Affordable Health Care (Obamacare).  In the 2010 Midterm Election a goodly number of the people who had voted for him in 2008 were disgusted with his lack of “change” and stayed at home and didn’t vote.  That combined with Voter Suppression in Republican dominated states gave control of the House of Representatives to the Republicans and the chances for change in the U.S. dropped to zero.

The probability of a Republican being elected in 2016 and both Houses of Congress maintaining their Republican majority is slim.   But even if it were to happen the possibility of a Republican president agreeing completely with a Republican Congress is even slimmer.  In fact the two Republican Houses of Congress agreeing is even slimmer than that, seeing that the current Republican House of Representatives is much farther to the right in their positions than the Republican dominated Senate.

What is needed at this time is a realistic look at elections and an understanding of the importance of voter continuing participation.  Elections are important.  Their results helps determine the direction in which the country proceeds.  Being not bothered to vote or a protest non-vote is actually a vote for the minority party, the Republicans.

There are currently a plethora of Republican candidates vying for the Presidency in 2016.  In fact the leadership of the National Republican Party seems bankrupt of power since they don’t seem to have any control over the choice of one or a few possible candidates.

For the Republicans there are currently fifteen announced candidates and seven additional potentially pending candidates.  This makes a total of twenty-one people who are vying for the presidency from the Republican Party.

The stated candidates are:

  13. Chris Christie as of June 30, 2015
  14. Scott Walker as of July 13, 2015

Also announced are Mark Everson & Jack Fellure

Other potential candidates are:

  1. John Kasich
  2. Bob Ehrlich
  3. Jim Gilmore
  4. Peter T. King

That makes a total of 21 potential presidential candidates

The next question is: How will they debate one another?   If they were all present in a single debate, the answers to each question would last for more than an hour and many TV viewers would forget at least half the answers before the question was answered. Fox News, the formal propaganda agency for the Republican Party, had a formula to just allow a certain number of the candidates leading in the national polls to debate but that’s been rejected by several state parties.  Whatever happens here will be colorful and interesting.

If you’re interested in any of the multitude of Republican candidates, look them up on the internet or, if you’re patient wait to see who’s left when we get to November of 2015. I suspect many of these individuals don’t and won’t have the organization, funding, or ability to mount 50 plus campaigns and will gradually fade away.

For the Democrats there are also a host of candidates but only two or three of them seem to have the organization to hold elections in each of the 50 states and each of the Federal Territories held by the United States.  They are, in the order of national poll preference, Hillary Rodham Clinton, Bernie Sanders, and Lincoln Chafee.

Of the Democratic candidates, Hillary Rodham Clinton is the best known.  She is the wife of former President Bill Clinton, a former well-functioning U.S. Senator, and President Barak Obama’s first Secretary of State.  No one running for the Presidency for the first time has been as experienced as she.  Hillary Clinton is running on a liberal platform.  For her to bring about her agenda she will need a majority in both the House and Senate.

Bernie Sanders is 74 years old.  Politically, he is a Democratic Socialist, who caucuses with the Democratic Party.  He has served in the Senate since January 2007.  Sanders favors policy proposals similar to those of social democratic governments in Europe, particularly Scandinavia, such things as free medical care for all and free college education for all.  His basic premise is that the U.S. is the richest country that has ever existed but the bulk of this wealth is going to the one percent who are not even paying their fair share of taxes.  He is currently the voice of many frustrated Americans who feel there is an extreme need for change in the United States but don’t see any of this occurring.  Sanders is running for the presidency as a Democrat.  Like Hillary, if he is elected he will need a Democratic Congress to bring about any change or he will spend four frustrated years as President not being able to do much.

Lincoln Chafee’s father, John Chafee, was the Republican Senator from Rhode Island where he died in 1999.  His son, Lincoln, was appointed by the governor of the state to finish his term.  Lincoln Chafee had entered politics in 1985 as a delegate to the Rhode Island Constitutional Convention.  The following year he was he became a member of the Warwick City Council, where he served until he was elected mayor of Warwick in 1992.  He served in that office until his father’s death in 1999 when he was appointed to the U.S. Senate to finish his father’s term.  In 2000 he won a full term to the U.S. Senate, defeating his Democratic rival.

Lincoln Chafee was a liberal Republican whose beliefs stood to the left of some conservative Democrats.  He opposed eliminating the estate tax, voted to increase the top federal income tax rate, was against allowing drilling in the Arctic National Wildlife Refuge, supported an increased minimum wage, and was the only Republican to vote against the invasion of Iraq.  He is pro-choice, supports same-sex marriage, affirmative action, gun control, and opposes the death penalty.

In 2007 Chafee left the Republican Party and became an Independent.  He supported Barak Obama in 2008.  In 2010 he became governor of Rhode Island.  Chafee was a co-chair of Obama’s 2012 re-election campaign.  In May of 2013 he announced that he was switching to the Democratic Party.  He formally announced his campaign for the presidency on June 3, 2015.

What are his chances of becoming the Democratic candidate?  An interesting question. He doesn’t seem as nationally well known as either Clinton or Sanders.  And both of them have wide recognition and positive reputations with Hillary, probably leading.

With the senseless murder of the nine church members in the leading Black church in South Carolina Hillary Rodham Clinton has taken on the terms of leading a Crusade across the country which the majority of the American population seems to want.  Of course, if she is elected, her success will depend upon the makeup of the two Houses of Congress.  The Democrats need not only a majority in both Houses of Congress but also a filibuster-less Senate, that is a 60 vote majority in that House. Then if the Democrats can work lock-step a Crusade to change America positively can be carried out.

The Weiner Component #70 – Intentions of the Framers of the Constitution

One of the major objects, if not the major object, of the framers of the Constitution was to create a government of the majority with protections for the minorities.  A true Democracy is supposed to express the will of the majority.  The major reason for education in our society was to create a population capable of reasoning and therefore able to elect the best people capable of representing them.

Today instead the object of government as applied by the far right and the evangelicals is to create a government where they, the minority, rule and set the standards for the majority.  Through the use of seemingly endless amounts of money in advertising, gerrymandering, and outright prefabrication they have been able sway elections to give themselves the power to impede necessary reforms and cause untold misery in the nation.

The Republican Party has been vociferously attacking Affordable Health Care (Obama Care) since they were able to gain control of the House of Representatives in 2011.  With the upcoming Midterm Election in November of 2014 the leadership of the Party has promised to make that a major issue, destroying Obama Care.

In a March Special Election in Florida, in an overwhelmingly Republican District, the Republican candidate just barely won the election.  Interestingly he treated his victory as one in which he totally trashed the Democratic candidate and the overall bulk of the population in his District voted to get rid of Obama Care.  The reasoning by the candidate and the party seems to be fallacious.  Presumably the new basis of the November Election in 2014 will be to elect Republicans so they can do away with Obama Care.

This seems to be in the opinion of many of that group a way to regain control of Congress.  The concept is fascinating since the entire concept of Obama Care was originally developed by the Heritage Foundation, a Republican Think Tank, and initially set up in Massachusetts under Republican Governor Mitt Romney.  It would seem that the reason for attacking Obama Care is to gain political power In Washington, D.C.

Interestingly, if we take the different parts of Obama Care and discuss them with the general public we find that they like the parts.  For example, keeping a child on their parents medical plan until he or she is 26 if the youngster is going to college, insurance companies not being able to reject people because of a prior condition, overall lower insurance rates for most people, no maximum limit in terms of what the insurance company has to spend on any condition, etc., etc.  But then if you ask them what they think about Obama Care the answer is that they don’t like it.

What seems to have happened is that the Republican prefabrications, like death panels and other nonsensical statements, which the Republicans have repeated over and over again, have, more or less, taken hold.  A good percentage of the people do not associate Affordable Health Care with the benefits it’s so far provided.  It can also be stated that the Democrats have not provided enough positive information to the public compared to the Republicans who have given redundantly endless negative statements.

In addition to using Obama Care as a means of gaining political power the wealthy Republicans like the billionaire Libertarian Koch Brothers have begun, through groups they fund, utilizing television and other forms of advertising as early as March for the oncoming November Election.  The probability is that billions will be spent on the Midterm Election.  And most of this money will be spent by the Republicans attempting to buy power by trying to gain control of the Senate and keeping control of the House of Representatives.  This is also true for state elections.

Will they gain control?  An interesting question!  We’ll have to wait and see.  Can the American voter be bought by propaganda and go against his/her own economic interests?

If the Republicans are successful the country will have total gridlock for 2015 and 2016.  They will not have a supermajority in the Senate and the Democrats will do what they, the Republicans, have done from 2009 on, filibuster the bills they are against and the President will veto the bills he is against.  They might try to impeach him as they did President Clinton; but, I suspect, they will have a problem doing so.  Of course they might be able to push through some strange laws, that the President would consider unconstitutional and break, as they did in 1868 with President Andrew Johnson.  But that did not effectively work then even with supermajorities in both Houses of Congress.

If the Republicans were to gain control of Congress in 2015 they would have to find positive reasons for running the country and they would also have to be able to work with the President.  At this point none of this seems possible.  All they have done since 2011 has been to impede all programs for which Obama could claim credit.  They haven’t been for anything except lowering taxes for corporations and the upper 1%.  The Republicans have done an outstanding job of keeping the country in a recession, attacking woman’s rights, and limiting benefits in entitlement programs for the poor and needy.  Paul Ryan, for example, has defined sloth as a racial thing.  It will be interesting to see what happens.

The Weiner Component #65 – Dysfunctional Government

A dysfunctional family is one that is perennially in chaos.  Nothing ever gets done; no issue is ever solved; nothing is ever accomplished.  A dysfunctional government works or doesn’t work on the same basis.  Its lawmakers are incapable of accomplishing anything, at least anything that the nation really needs.

Is that the situation that exists in Washington, D.C.?  The answer to that question is obviously, yes.  But is the answer that simple?  Are both political parties equally responsible or is the true villain just one of the particular political parties?

Toward the end of the last year of the reign of George W. Bush as President of the United States the economy collapsed.  Because of the activities of the major banks the country was facing a catastrophe greater than that of 1929.  Bush and his Secretary of the Treasury, Paulson, did an emergency bank bailout of the big Financial Institutions whose greed and irresponsibility had caused the situation.

In 2008 Barak Obama was elected President on a platform of: “It’s Time for a Change.”  Through the use of both Fiscal and Monetary policy he was able to avert a major breakdown of the economy.  In addition he bailed out the auto industry.  The country had a recession with major unemployment but it never reached a real depression.  The Obama Administration also passed a universal Affordable Health Care Bill, which, had been initially suggested by the Horizon Institute, a Conservative Republican Think Tank and earlier put into operation in the State of Massachusetts by a Republican governor, Mitt Romney.

In the 2010 Midterm Election the Republicans under Tea Party leadership became the majority party in the House of Representatives.  Apparently there hadn’t been enough “change” during President Obama’s first two years in office!

The Republican caucus in both Houses of Congress had earlier decided the Obama would be a one term president.  Mitch McConnell, the Republican minority leader in the Senate had announced this publically.  They would support nothing that President Obama proposed.  In fact, they would oppose everything he would favor.  Government functionality would cease.  From 2011 on the House of Representatives would not pass any bill that supported any program that Obama or the Democrats favored and that they would oppose any bill that had been passed during his first two years in office.

The House repealed Affordable Health Care (Obama Care) over forty times.  The repeals went nowhere because the Senate had a Democratic majority and the majority leader would not take up the bill which was already law.

In 2011 President Obama came out with a plan to put America back to work by both extending and modernizing the infrastructure of the United States.  This would probably have reduced unemployment to about 3 1/2 percent, increased the GDP significantly, and substantially increased the tax base of both the Federal Government and the states.  The Republican majority and the Speaker of the House of Representatives completely ignored these plans.  The House of Representatives from 2011 on has done absolutely nothing in any way to create jobs for the unemployed.  By their actions they have sought to reduce government employment and have actually added to the unemployment problem.

In 2012 the House of Representatives met in formal session 125 days, in 2013 it was 121 days, and in 2014 it will be for 120 days.  Some Republican legislator made a comment about what will they do in all that time.  The members of Congress receive 174 thousand dollars a year, plus an office and a fully paid staff.  The get an allowance for an office in their home districts.  I would love to work 120 days out of 365 for that pay and do as much as the House Republican legislators!

In 2013, late at night, the Republicans changed the rules in the House of Representatives so that only bills favored by the majority party could be brought up for a debate or vote on the floor of the House.  If a bill favored by the Democrats and a small number of Republicans came up, the Speaker of the House did not have to call for a vote on that bill, even if the majority favored it.  The only bills that needed to be brought up were those favored by the majority of the Republicans in the House.

In the Senate the Republican minority can filibuster both bills and Presidential appointments of judgeships and appointments of assorted department heads.  The position of the Director of the Bureau of Alcohol, Tobacco, & Firearms was only recently filled after being vacant for six to eight years.  The NRA wanted this job left vacant.  The post was filled after Harry Reed, the majority leader, threatened to change the rules and end filibustering most Presidential appointments.

In mid-November, over the issue of three judgeships, in which the Republicans refused to allow a vote to be taken because they did not want Obama to fill three vacancies in the second highest court in the U.S., the Senate by a simple majority changed the rules and disallowed filibustering in most presidential appointments.

In 2012 the closest the Republicans came to a compromise was the Sequester, which automatically dropped government spending across the board on all levels except Congressional salaries that automatically rose every year.  These, cut down military spending and innumerable entitlement programs for the poor: meals on wheels and infant nutrition to name only two.  In 2013 they shut down the government, refused to raise the debt ceiling, and cost the country about 24 billion dollars and around 250,000 jobs.  If they had had their way and gotten everything they wanted the country would currently be in a deep depression with unemployment up well over 25 percent.  Their version of running the government is not only to not spend money but also to massively reduce the size of the Federal Government.

Even though the public cast 1.4 million more votes for the House Democrats in 2012, by gerrymandering in the census year, 2010, the Republicans still got a majority in the House.  The country will need an overwhelming majority in 2014 to beat them.

There is a note of irony that helps explain this dysfunction.  Since the Republicans have determined to oppose everything that President Obama supports they have gone against some policies that initially were their own.  The reason for this, as we have seen, was to make Obama a one term president.  When they failed in 2012 they still adhered to these policies.

 

Affordable Health Care will help keep a number of people alive who would otherwise have died earlier because they could not afford to see a doctor until it was an emergency.  Many children will now get prenatal care.  The insurance companies, even with more restrictions on what they can do, will get a tremendous increase in business.  Yet the Republicans continue to denounce this law using mostly general platitudes.  They offer nothing except the argument that it’s no good, that it will harm the society and kill jobs.

We are probably the only industrial nation in the world today that doesn’t have universal medical care for its citizens.  Our original system of medical care is faulty, inefficient, and overly expensive.  The Republicans offer no alternative except that Obama Care is no good.  Really spiteful reasoning!

We can again ask ourselves: Why is Congress dysfunctional?  The answer is because of Congressional Republican acts or lack of any action since 2011 when they gained control of the House of Representatives.  The 2014 Midterm Election will determine what direction this country takes.  If the Republicans retain the majority in the House we can look forward to two more years of economic disaster.  The American People will have to choose in 2014.  Hopefully the majority will understand their choices.  Unfortunately we have to wait another year before there’s any hope of a functioning government.
